Defamed Elizabeth Holmes, the CEO of Theranos, is asking for a delay in the start of her nearly 11-year prison sentence while her lawyers appeal her conviction for misleading investors about the capabilities of the blood-testing technology used by her former business. Holmes also marks the birth of her most recent child as a rational reason.

In court papers submitted last week in advance of a hearing on March 17 addressing Holmes' request to remain free while an appeals process that could take years to complete, the birth of her second child was confirmed.


In her appeal, Holmes isn't just saying that she shouldn't go to jail because of her two kids. Her lawyers claim that several errors and abuses that happened during her trial raise the probability that her sentence will be reversed. In addition, they are referencing Holmes' spotless record while out on bail for the four and a half years following her criminal charge as proof that she is not a threat to the public.

The court filing read,” Ms. Holmes has deep ties to the community: She is the mother of two very young children; she has close relationships with family and friends, many of who submitted letters at sentencing vouching for her good character; and she volunteers with a rape crisis and counseling organization.”

Although the application submitted for filing does not disclose the child's birth date and gender as well. At the time of her sentencing on November 18, Holmes, 38, was expecting a child in the same San Jose, California, courtroom where a jury had previously found her guilty of four felony charges of fraud and conspiracy.

As of now, Elizabeth Appeals to the court in advance for the delay in prison sentence because of her pregnancy as Billy Evans, her fiancé and the father of her first child, had confirmed her pregnancy in a court filing. However, a decision of the court is pending yet.
