While serving as attorney general, he successfully argued for the exhibition of the Ten Commandments in Texas' State Capitol and failed to defend the state's prohibition on gay marriage in the 2005 US Supreme Court decision Van Orden v. Perry.

As part of a number of lawsuits against the Obama administration aimed at invalidating the Affordable Care Act and the Obama administration's environmental policies, he was a prominent figure.
